Terms of service

The agreement between you and AxoWatch — what you get, how plans and payments work, what you may monitor, and what each side is responsible for.

These terms are the agreement between you and Sybrik Development, a business in Ontario, Canada, that runs AxoWatch ("AxoWatch", "we", "us"). They cover the website at axowatch.com, the AxoWatch app, the AxoWatch Chrome extension and our MCP connection — together, "the service".

By creating an account or using the service you accept these terms. If you sign up on behalf of a company or for a client, you confirm that you may accept them for that company, and "you" means it as well.

How we handle personal data is described in our privacy policy, which is part of these terms.

The short version

  • Monitor only sites you own or are allowed to test.
  • Paid plans renew automatically at the end of each period until you cancel.
  • When you cancel, your plan keeps working until the end of the period you paid for, then it is not renewed and you are not charged again.
  • We do not give refunds, including for unused time.
  • Monitoring and AI help make it easier to notice and fix problems, but they do not guarantee your site works. You decide what to deploy.

Your account

You need an account to use the app. Give us a real name and an email address you read — we send alerts, receipts and important notices there.

Keep your password and tokens to yourself. You are responsible for what happens in your account, including what the people you invite do in it. The person who creates the account is its owner: owners manage people, the plan and payments; members work with the sites as the owner allows.

AxoWatch is a tool for businesses. You must be at least 18 to use it.

Plans and payments

Free. The Free plan costs nothing and needs no card. Its limits are shown on the pricing page.

Paid plans are billed in advance, monthly or yearly, at the price shown on the pricing page when you subscribe. Payments are processed by Stripe; we do not see or store your full card number. Prices do not include taxes — where tax applies, it is added at checkout.

Renewal. A subscription renews automatically at the end of each period and your card is charged for the next one, until you cancel.

Changing plans. Moving to a higher plan, or from monthly to yearly, takes effect at once; you pay the difference for the rest of the current period. Moving to a lower plan takes effect at the start of the next period.

Cancelling. You can cancel at any time in the app under Settings → Subscription. Your paid plan keeps working until the end of the period you already paid for. After that the subscription ends, no further payments are taken and the account moves to the Free plan. You can resume the subscription before the period ends.

No refunds. Payments are not refundable, in whole or in part — including for the unused part of a period, for moving to a lower plan and for an account that was not used — except where the law requires one or these terms say otherwise below.

Limits. If an account has more than its plan allows — after moving to a lower plan, for example — we pause the newest checks and flows above the limit. Nothing is deleted: you can choose what stays on, or move to a higher plan.

Failed payments. If a renewal payment fails, Stripe retries it over the following days. If it still cannot be collected, the subscription ends and the account moves to the Free plan.

Price changes. We may change our prices. A new price applies to your subscription only from the next period, and we tell you at least 30 days before it does. If you do not want to continue at the new price, cancel before the renewal.

What you may monitor

The service visits sites, opens pages in a real browser, walks paths such as sign-up or checkout, and measures speed. You may point it only at sites and systems that you own or that you are allowed to test, and you are responsible for having that permission.

You may not use the service to:

  • monitor, test or load sites you are not allowed to;
  • put a site under heavy load, test how much load it takes, or try to break or get around its security;
  • collect data from other people's sites or accounts;
  • run flows with real personal or payment data of other people — use test accounts and test cards;
  • send us anything unlawful, malicious, or that you have no right to send;
  • get around our plan limits, share one paid account between unrelated businesses, or resell the service without our written agreement;
  • copy, reverse-engineer or attack the service, or use it to build a competing product.

An agency may monitor its clients' sites from its own account, provided each client has agreed.

Your data

What you put into AxoWatch, and what the service collects from your sites for you, stays yours. You give us permission to store, process and show it only so far as we need to run the service for you, keep it secure and help you when you ask.

Error reports, screenshots and page texts can contain data about your site's visitors. For that data you decide what is sent, and you are responsible for telling your visitors about it and having a legal basis to collect it. We process it on your behalf, as described in the privacy policy. If you need a data processing agreement, write to us.

When your account ends, we delete your data as the privacy policy describes. Before that, you can delete what you need in the app, or write to us for a copy of your data.

AI features

AxoWatch uses AI to build, explain and repair flows, to explain errors, and to prepare fix tasks for you or your own AI agent. AI can be wrong. Read what it suggests before you rely on it, and review any change to your code before you merge or deploy it — that decision is yours.

Other services you connect

When you connect Slack, Microsoft Teams, Telegram, email, a webhook or your own AI agent, the data you send there is handled under that service's terms. We are not responsible for services we do not run.

Our service

AxoWatch, its software, design and content belong to us. These terms give you the right to use the service while your account is active; they do not give you any other rights to it. If you send us ideas or feedback, we may use them freely.

We keep improving the service, so features may change. We aim to keep it available, but we do not promise it will be uninterrupted or that a check will never be missed or delayed: monitoring can miss an outage, and it can raise an alert when nothing is wrong. Do not rely on AxoWatch as the only safeguard for systems where a failure could cause injury or serious loss.

Disclaimers

Except as these terms say otherwise, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement — to the extent the law allows.

Limitation of liability

To the extent the law allows:

  • we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or business opportunities, even if we were told they were possible;
  • our total liability for all claims about the service is limited to the amount you paid us in the 12 months before the event that caused the claim.

Nothing in these terms limits liability that cannot be limited by law.

Your responsibility to us

If someone makes a claim against us because of how you used the service — for example, because you monitored a site you were not allowed to, or sent us data you had no right to send — you will cover our reasonable costs and losses from that claim.

Suspension and ending the account

You can stop using the service at any time and ask us to delete your account.

We may suspend or close an account if it breaks these terms, puts the service or other people at risk, or if the law requires it. Where we reasonably can, we tell you first and give you a chance to fix the problem. If we close a paid account without a breach on your side, we refund the unused part of the period.

The parts of these terms that by their nature should last after the account ends — about payments already made, data, disclaimers, liability and the law that applies — continue to apply.

Changes to these terms

If we change these terms, we update the date at the top. If a change matters to how you use the service, we tell you in the app or by email at least 30 days before it takes effect. Continuing to use the service after that means you accept the new terms; if you do not, cancel before they take effect.

Law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute goes to the courts of Ontario, unless the law where you live gives you a right to bring it elsewhere.

If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a part of them right away, we have not given it up.
